NOTICE OF SALE
WHEREAS, on, June 10, 1988, Alphonse C. Poyadue and Lucille R. Poyadue, being one and the same person as Loucille R. Poyadue, executed a deed of trust to Frank W. Neimeyer, Jr., Trustee for the United States of America, acting through the Farmers Home Administration, United States Department of Agriculture, recorded in Deed of Trust Book 318 at page 630 of the records of the Chancery Clerk of Hancock County, Mississippi; and
WHEREAS, the United States of America, acting through the Farmers Home Administration, United States Department of Agriculture, the holder of said Deed of Trust and Note secured thereby, substituted J. Tyler McCaughn as Trustee therein as authorized by the terms thereof by instrument dated July 3, 2019, and recorded in Book 2019, Page 15677, in the office of the Hancock County Chancery Clerk; and
WHEREAS, default having been made in the terms and conditions of said Deeds of Trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms in said Deeds of Trust and the legal holder of said indebtedness, the United States of America, acting through the Farmers Home Administration, United States Department of Agriculture, having requested the undersigned, as Substituted Trustee, to execute the trust and sell said land and property in accordance with the terms of said Deed of Trust for the purpose of raising the sums due thereunder, together with attorney's fees, Substituted Trustee's fees and expenses of sale.
NOW, THEREFORE, I, J. TYLER MCCAUGHN, Substituted Trustee in said Deeds of Trust, will, on the 21st day of November, 2019, offer for sale and will sell at public outcry to the highest bidder for cash, within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.) at the main front door of the Hancock County Courthouse in Bay St. Louis, Mississippi, the following described property lying and being situated in the County of Hancock, State of Mississippi, to-wit:
Being located on the North line of Washington Street in the Rear of the Old Third Ward of Bay St. Louis, Ms., in Hancock County and being all of Lot 36 and all of the Southeastern 50 feet of Lots 37 and 41 of the original division of the Rear of the Old Third Ward of Bay St. Louis, Ms., and according to the E. S. Drake Tax Map of City of Bay St. Louis, Ms., adopted for record on May 1, 1923 and on record in the office the Chancery Clerk and being more particularly described by metes and bounds, as follows, to-wit:
Begin for survey at the intersection of the North line of Washington Street and the Western line of Old Spanish Trail; thence go N 70 degrees West along the North line of Washington Street for a total distance of 490 feet to an iron pin at the SE corner of Lot 36 Rear of Old Third Ward and being true point of beginning of above said parcel of property; thence continue along the south line of Washington Street N 70 degrees West for 112 feet to iron pin that is fifty feet West of East line of Lot 41; thence go N 20 degrees East for 132 feet to iron pin in fence line; thence go S 70 degrees East and along the north line of Lots 36 and 37 for a distance of 100 feet to iron pin in the NE corner of Lot 36; thence go S 15º00' degrees W for a distance of 135 feet along southeast line of Lot 36 to iron pin on the North line of Washington Street and point of beginning.
I will only convey such title as is vested in me as Substituted Trustee.
