STATE OF MISSISSIPPI COUNTY OF HANCOCK TRUSTEE’S NOTICE OF SALE WHEREAS, CARMINE A. ZAZZARO (“Owner”) held fee simple title in and to the real property described below (the “Subject Property”); and WHEREAS, the Subject Property is a condominium unit at Molokai Village Condominiums (“Molokai”), being governed by the Molokai Owner’s Association, Inc. (the “Association”) pursuant to the By-Laws of the Association and the Declaration of Condominium, as they may be amended from time to time; and WHEREAS, pursuant to the Association’s By-Laws and Declaration of Condominium, and Section 89-9-1 et seq. of the Mississippi Code (the Mississippi Condominium Law), all owners of condominium units at Molokai are required to pay the monthly dues/assessments to the Association, the failure of which may result in accelerated collection of unpaid balance for the current year, a lien on the owner’s unit to be recorded in the public records of Hancock County, and ultimately foreclosure; and WHEREAS, default having been made by Owners in the payment of Association dues/assessments, and the Association having filed its Notice of Lien, which was filed in the land records in the office of the Chancery Clerk of Hancock County, Mississippi as follows: (a) in Deed of Trust Book 2022 at Page 24277 on August 10, 2022; and (b) in the Condominium Lien Book 2022 at Page 1 on September 14, 2022, and the Association having requested this sale for the purpose of paying any indebtedness or as much thereof as said sale brings; NOW THEREFORE, I, Je’Nell B. Blum, counsel for the Association, will on the 13th day of October, 2022, within lawful hours, being between the hours of 11:00 O’Clock A.M. and 4:00 O’Clock P.M., offer for sale and will sell at public outcry to the highest bidder for cash, at the main front door of the Hancock County Courthouse in the City of Bay St. Louis, County of Hancock, State of Mississippi, the following described real property situated and being located in the County of Hancock, State of Mississippi, and being more particularly described as follows, to-wit: Apartment 125, in Building “G” of DIAMONDHEAD Condominium No. 1, Amended Plat of Fairway 12, Condominium Complex Lot “C”, as recorded in Plat Book No. 4 pages 46-47, inclusive, and according to the Declaration thereof dated August 14, 1972, and recorded in Deed Book X-8 at pages 7-29, re-recorded on the 15th day of December, 1972 in Book Y-1 at pages 92-115, and amendments thereto dated the 15th day of December, 1972, and recorded in Deed Book Y-1, at pages 116-119, of the Public Records on file and of record in the office of the Chancery Clerk of Hancock County, Mississippi. Together with all the appurtenances thereof, all according to the said Declaration of Condominium, along with an undivided 1.2 percentage interest in the common elements of said project as described in said Declaration as amended, including the land hereinabove described, and the building located thereon. Together with the rights of ingress and egress to and from said units and the right in common with the other owners from time to time to use and enjoy said common elements, all as set forth in the Declaration, and all exhibits thereto, as the same may be from time to time amended. Together with all of the tenements, hereditaments and appurtenances with every privilege, right, title, interest and estate, reversion, remained and easement thereto belonging or in any wise appertaining. There is excepted and reserved herein from any portion of the common elements lying within said unit an easement through said unit appurtenant to the common elements and all other units, all as set forth in the Condominium Declaration for Molokai Continuums hereinabove referenced, together with rights set forth in said Declaration. Subject, however, to all of the provisions of said Declaration of Condominium, and to the By-Laws and Rules and Regulations of the Molokai Owner’s Association, which the Grantee herein assume and agree to observe and perform, including, but not limited to the payment of assessments for the maintenance and operation of said unit and condominium. I will convey only such title as is vested in me as counsel for the Association and by virtue of the laws of the State of Mississippi, including, but not limited to, Sections 89-1-55 and 89-9-21 of the Mississippi Code of 1972, as Amended, and such title shall be conveyed without representations or warranties of any type whatsoever, and subject to any encumbrances of record.
