KINGSTON, to remove cloud in title and for other relief seeking to have a certain unreleased deed of trust declared satisfied and released that is still showing as open with regard to that certain property legally described as: LOT 37, Square 145, BAYSIDE PARK SUBDIVISION, Unit 2, Hancock County, Mississippi, as per plat of said subdivision of record in the office of the Chancery Clerk of Hancock County, Mississippi. Plaintiff, ADRIAN R. KINGSTON, obtained his interest in the subject property by virtue of that certain QUITCLAIM DEED dated March 18, 2015, and recorded in Book 315 at page 3090 in the office of the aforesaid Clerk. The Deed of Trust sought be declared void is as follows: Defendant, Matrix Funding Group, LLC, is the assignee of that certain Deed of Trust initially granted by Adrian R. Kingston and Susan Kingston to Danny Crotwell, Trustee for the benefit of United Mortgage Corporation in the amount of one hundred twelve thousand five hundred and 00/100 dollars ($112,500.00) dated December 7, 2007 and filed of record on January 3, 2008 in Book 2008 at Page 376 in the Office of the Chancery Clerk of Hancock County, Mississippi. That deed of trust was subsequently modified by that certain Loan Modification Agreement between the same Grantor and Beneficiary of the initial deed of trust described above dated April 2, 2008 and filed of record on April 10, 2008 in Book 2008 at Page 14227 in the office of the aforesaid Chancery Clerk. Subsequently, the loan was assigned by Consent Judgment entered in the United States Bankruptcy Court Middle District of Florida, Ft. Myers Division, filed of record on February 22, 2011 in Book 2011 at Page 2760 in the office of the Chancery Clerk of Hancock County, MS. If you have a legal or equitable claim or interest in this property and/or deed of trust, you are required to mail or hand-deliver a copy of your response to the Complaint to Remove Cloud in Title and For Other Relief to the attorney for Plaintiffs, Negrotto & Associates, PLLC, c/o Lewie G. “Skip” Negrotto, IV, the attorney for Plaintiffs, whose post office address is 220 E. Scenic Drive, Suite 200, Pass Christian, MS 39571.
